Victims’ families file suit against Warren County

Wrongful death suit filed due to poor road maintenance

Recently, a wrongful death lawsuit was filed against local officials for not maintaining a road in eastern Ohio where six teens from Warren, OH were killed in a motor vehicle accident in 2013. The accident happened on 10 March 2013 when an SUV driven by a nineteen-year-old woman crashed and took her life and the lives of five of her seven passengers.

After an initial investigation, authorities said that the driver was speeding down the two-lane road at nearly 70 mph before it flipped and rolled into a small pond in the early hours of 10 March 2013 along Route 69.

Last Friday, relatives of three of the boys–a fourteen-year-old and two fifteen-year-olds–filed a lawsuit against Warren and Trumbull County. The lawsuit states that they are seeking at least $25,000 in compensatory and bereavement damages. The lawsuit claims that regardless of the speed of the vehicle, the guardrail that it struck was not maintained and that poor maintenance allowed the vehicle to flip and land in the pond.

An assistant prosecutor from Trumbull County on Tuesday said that he will review the claims in the lawsuit and speak to Trumbull County's insurance provider. He could say nothing further because it is considered a pending case. Warren officials said that they will also speak to the insurance provider.

The initial investigation revealed that the driver did not have a valid license when she crashed, and a witness who survived told police that she was intentionally swerving on the road for fun. Toxicology reports showed the woman was not under the influence of drugs or alcohol and police say that they do not believe that anyone else in the vehicle may have cause the accident.
