Wrongful death lawsuit asserts defective tire to blame for crash

When someone dies unexpectedly in an accident of any kind, it can be difficult for those who loved that person to come to terms with his or her death. When that person's death is due to negligent actions of another, it is that much harder. While there is nothing that can be done to undo a fatal accident, loved ones of the victim do have legal recourse.

A family member of a married couple who died in a motorcycle accident last year recently exercised that right. The couple died in a Westmoreland County motorcycle accident. Unlike many motor vehicle accidents we often write about on this blog, the cause of the crash was not another vehicle, but rather a motorcycle component. A blown tire was apparently to blame.

The wrongful death lawsuit filed by the couple's son names the maker of the tire that blew as well as a motorcycle retailer as defendants. The claim indicates that the blowout was due to a defective tube that was inside the tire. It also asserts negligence on the part of the tire maker was responsible for the crash. The amount sought in the lawsuit is unknown.

Wrongful death lawsuits such as this one that involve a defective product are often very complicated in a legal sense. In addition, they are often difficult emotionally for the individuals who file them. When successful however, they result in not only monetary compensation but often a sense of closure for the individual who brought the lawsuit as well.
