An Ohio motorcycle accident has left two victims — the motorcycle driver and passenger — severely injured. According to Ohio State Patrol, the motorcycle accident occurred when a van failed to yield to the motor yesterday morning. The van driver remains uninjured.

However, the same cannot be said of the pair that was astride the motorcycle, unfortunately. Both victims were ejected from the motorcycle and neither was wearing a helmet. The driver crashed into the windshield of the car, breaking the glass with his body. He was airlifted to Parkview regional medical center.

The motorcycle passenger was airlifted to the same hospital after being transported; she just had her condition upgraded from critical to serious. Hopefully both will have a speedy and full recovery.

On the road to such a recovery, the injured pair is sure to incur severely costly medical expenses. Additionally, the motorcyclists are not liable for not wearing helmets at the time of the crash as there is no law in Ohio against not wearing helmets.

While this negligent driver may face legal repercussions, he could also be held liable civilly if the injured motorcyclists choose to file a personal injury claim.

Such a claim could allow the injured pair not only to recoup for their likely highly expensive medical bills and lost wages, but if successful it could also allow recompense for the pain and suffering they were forced to endure at the hands of this negligent Ohio van driver.
