Pittsburgh Workplace Accident Duty to Notify

Were you injured in a workplace accident in Pennsylvania or Ohio? Are you considering filing for workers’ compensation benefits for an injury or illness suffered on the job? Before you can file with the workers’ compensation office, you are required to notify your employer of your intent no more than 120 days from the date of the injury. If you fail to notify, your employer can refuse your claim, and you will be barred from all benefits pertaining to the accident and resulting injuries.

What Qualifies as Notification After a Workplace Accident?

It is not sufficient to simply tell your co-workers that you intend to file a workers’ compensation claim. The official notification should be in writing, submitted through your company’s personnel department. It is considered sufficient notification if your immediate supervisor is aware of the accident and injury, but it is best to ensure that the supervisor reports the incident to management.

Have You Already Missed the Deadline?

If more than 120 days have passed since your accident injury, you may still be able to apply. It is possible that your employer was made aware of the accident, which may be regarded as official notification. Don’t assume you have lost your opportunity. Talk to an experienced workers’ compensation lawyer in Pittsburgh.
